The Provisions To Encourage Multinational Corporations To Establish Regional Headquarters In Beijing

Article 1        These provisions have been formulated in accordance with relevant laws and regulations, while taking into consideration the realities in Beijing, in order to facilitate the economic development of the capital and to encourage multinational corporations to establish regional headquarters in Beijing.

Article 2        The term ‘Regional Headquarters of a Multinational Corporation’ (referred to as the “Regional Headquarter”), means the sole head office which is registered and established in Beijing by means of investment and authorization by a foreign multinational corporation to manage and serve its subsidiaries through administrative and service functions in one or more state administrative regions. Hong Kong, Macau and Taiwan registered multinational corporations with regional headquarters registered and established in Beijing will refer to these provisions.

Relevant policies and regulations that promote financial development are applicable to regional headquarters of foreign-funded financial institutions established in Beijing.

  

Article 3        Newly registered regional headquarters that are established in, or relocated to Beijing after January 1, 2009 with a registered capital of RMB100 million and above, will receive a government subsidy base on the amount of registered capital. The government subsidy will be paid in installments over three years.

A corresponding subsidy will be given to regional headquarters that make a one-off increase to their registered capital amount to meet the stipulated quota.

Article 4        The leased office space of newly registered regional headquarters that are established in, or relocated to Beijing with a lease period of not less than 3 years, shall be subsidized for three years. During the period in which the subsidy is being received, it shall not be leased out, sublet or have its use changed. For those who have violated the above provisions, all subsidies shall be returned. This Article is to be experimented in Chaoyang District and implemented by the People’s Government of Chaoyang District. Other counties should refer to this article and implement it.

Article 5        Regional headquarters and their R&D centers that are established in, or relocated to Beijing after January 1, 2009 and having constructed or purchased their office space for their business, shall receive a one-time subsidy. Those receiving the subsidies shall not sell, lease out the office space or change its use for five years. Violators shall return any subsidies they have received.

Article 6        Starting from 2009, different levels of financial incentives are given to those regional headquarters with first time annual revenues of RMB100 million and above. The incentives shall be released in installments over three years.

Article 7        Regional headquarters may legally pursue investment management and decision making, production and operation management, capital operation and financial management, technical support and research and development, marketing services, import and export and domestic distribution, logistics and delivery services, information services, undertaking outsourcing services of the parent company  and other companies, staff training and management, as well as other business, management and service activities stipulated by the laws, regulations and provisions.

  

Article 8        Regional headquarters may establish a unified internal fund management system to implement a unified management of its own funds according to the relevant provisions. The operation of foreign exchange funds in this regard shall be implemented according to national foreign exchange management policy. Those regional headquarters that satisfy the requirements may provide some experimental operations like centralized management of foreign exchange and foreign loans in accordance with relevant provisions. In accordance with the Measures for the Administration of Finance Companies of Enterprise Groups, investment companies may establish a financial branch to provide centralized financial management services to investment enterprises invested in China.

Article 9        Customs and entry-exit inspection and quarantine authorities shall facilitate customs clearance for the import and export of goods of the regional headquarters and its R & D centers, and provide assistance to regional headquarters in the development of warehousing logistics, distribution and delivery, bonded processing and manufacturing, and high-end R & D operations in Beijing Tianzhu Free Trade Zone according to their actual needs.

Article 10      Starting from January 1, 2009, the Beijing Municipal Government will award cash rewards to the person in charge of the regional headquarter. The reward will be awarded on the following year for three years after the regional headquarter has been certified.

                    

The person in charge of regional headquarters with top ten increments in the local retained part of its paid corporate income tax in the first fiscal year will receive cash rewards from the Beijing Municipal Government.

In accordance with state regulations, the cash rewards will be exempted from personal income tax.

Article 11      Personnel occupying the post of vice general manager and above or

undertaking equivalent duties in the regional headquarters for more than two straight years will receive rewards according to regulations related to attracting top talents in Beijing.

  

Article 12      Foreign staffs of regional headquarters may enjoy the convenience of multiple entry and exit. Foreign high-level management and technical staffs, including legal representatives, general managers, vice general managers, chief financial officers, etc. of the regional headquarters, may apply for 5-year multiple entry “F” visa.

Middle-level management, like departmental managers and technical staffs may apply for 3-year multiple entry “F” visa.

Standard foreign employees may apply for 1-year multiple entry “F” visa. The above expatriates' foreign spouses and minor children may apply for the “F” visa of the same period with the above-mentioned persons. 

Foreign staffs holding “L” or “X” visa employed in regional headquarters may apply for “F” visa according to the above conditions for temporary entry, if required.

Foreign staffs of regional headquarters that fail to apply for a visa at the Embassy of The People’s Republic of China and its consulate in their countries, but need a short-term visit to China may apply for a visa at the Beijing Capital International Airport.

                    

Article 13      Foreign high-level management and technical staffs, including legal representatives, general managers, vice general managers, chief financial officers, etc. of the regional headquarters that require long-term residency in Beijing, may apply for a 5-year foreigner residence permit; Middle-level management, like departmental managers and technical staffs may apply for a 4-year foreigner residence permit. Common foreign employees may apply for a three-year foreigner residence permit. The above expatriates' foreign spouses and minor children may apply for a foreigner residence permit valid for the same period with the above-mentioned persons. The residence permits of the above mentioned foreigners should not exceed the validity of their passports.

In accordance with regulations, senior management executives of regional headquarters will be given priority in their application of the “Foreigner Permanent Residency Permit ".

Article 14      Chinese staffs of regional headquarters who need to go to Hong Kong and Macao for business, may apply for "Exit-entry Permit for Traveling to and from Hong Kong and Macau (EEP)" and business endorsement with multiple entry-exit. Those Chinese staffs going to Taiwan for business will be given priority in their application for "Travel Permit For Mainlanders to Enter and Exit Taiwan" if they have the approval documents of the Taiwan Affairs Office of The State Council and Taiwan travel documents.

Article 15      Regional headquarters intending to employ foreign workers to work in Beijing, shall apply for employment permission for these foreigners and the ‘Employment Certificate for Foreigners’.  

Article 16      Regional headquarters and its R&D centers in urgent need to hire senior management staffs and employees holding professional titles, who are master’s or higher degree holders and bachelor’s or higher degree holders, in which there is a shortage in the capital and under the age of 45, may apply for talent introduction permit.

Those employing personnel holding professional titles who are bachelor’s or higher degree holders, mid-level or higher qualification holders, may apply for ‘Beijing Employment Residence Permit’.

Article 17      The county government where the regional headquarters are located shall be responsible for providing assistance to senior management staffs whose children need to attend nursery school, elementary or middle schools.

Article 18      Foreign employees of regional headquarters may not be bound by the duration of their work permit in China in their purchase of private housing according to their actual needs.

Article 19      The Beijing Municipal Commission of Commerce shall be responsible for the authentication of regional headquarters in Beijing, fulfillment of subsidies and rewards as well as facilitating the coordination and implementation of policies. It’ll take the lead in carrying out external services to simplify administrative procedures and enhance work efficiency and service quality. 

Specific measures for the disbursement of the subsidies and rewards are jointly formulated by the Beijing Municipal commission of commerce, Beijing Municipal Commission of Development and Reform, Finance Bureau of Beijing, Beijing Local Taxation Bureau and Beijing Municipal Bureau of Statistics. The referred subsidies or rewards will be disbursed once a year after verification by the above departments and with the approval of The People’s Government of Beijing Municipality.

Article 20      These Provisions herein shall be implemented from January 1, 2009. Specific problems occurring during the implementation shall be coordinated and solved by the Beijing Municipal Commission of Commerce. The previously published The People’s Government of Beijing Municipality Issued A Notice On The Provisions To Encourage Multinational Corporations To Establish Regional Headquarters In Beijing (Issued By the People’s Government of Beijing Municipality No. 4 [1999]) shall be annulled.
